Effective January 1, 2009, two new California Privacy laws (SB541 and AB211) go into effect and will apply not only to UCLA Health System as a health facility, but also to each individual workforce member. Below is a summary of the laws and we have shared with managers and leadership as well as a presentation which also has or will be reviewed with you at staff meetings.

As a reminder, here are some of the important facts you need to know:
Under the new laws, UCLA Health System will have an obligation and duty to report any unauthorized access, review, viewing or disclosure of protected health information or personal information to the Department of Public Health and the patient involved within 5 days of when the unauthorized access is detected.
After the notification, the Department of Public Health and/or CalOHII can impose monetary fines and penalties against UCLA and the individual workforce member who had no reason to access the record.
Also, CalOHII may report the individual to his/her licensing board if he/she holds a license or certificate (e.g. Medical Board, Nursing Board.) and a violation for unauthorized review, access or disclosure is found.
